Overview

Welcome to BLUEYS! The terms "we", "us" and "our" refer to BLUEYS Bar, a partnership (vennootschap onder firma) registered in the Netherlands. BLUEYS operates this store and website, including all related information, content, features, tools, products and services, so we can offer you, our guest, a place to browse, order and book with us (the "Services"). Our online store is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with any policies referred to in them (these "Terms of Service" or "Terms"), set out your rights and responsibilities when you use the Services.

Please read these Terms carefully. They include important information about your legal rights and cover things like warranty disclaimers and limitations of liability. Nothing in these Terms affects your mandatory statutory rights as a consumer under Dutch and EU law — where these Terms and that law conflict, the law wins.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy [LINK]. If you don't agree to these Terms or our Privacy Policy, please don't use or access our Services.

1. Access and account

By agreeing to these Terms, you confirm that you are at least 18 years old, or that you have permission from a parent or guardian to use the Services. If you let a minor in your care use the Services on a device you own or manage, you're responsible for their use.

To use the Services — including browsing our online store, placing an order, or booking catering or a space — we may ask you for certain information, such as your name, email address, billing, payment and delivery details. You confirm that everything you give us is correct, current and complete, and that you're allowed to share it.

If you create an account, you're responsible for keeping your login details safe and for everything that happens under your account. You can't transfer, sell or hand your account to anyone else.

2. Our products

We've done our best to show our food, drinks and other products accurately online. That said, colours and appearance can look different on your screen depending on your device and its settings, so what arrives may not look identical to what you saw.

Because we cook with fresh, seasonal and often locally sourced ingredients, exact items, availability and presentation can vary. We don't guarantee that any product will look or taste exactly as shown online.

All product descriptions can change at any time, at our discretion. We may stop offering any product, and we may limit quantities or restrict orders to particular areas or customers, case by case.

Allergens and dietary needs. If you have a food allergy or intolerance, please tell us before you order. While we're happy to share ingredient information, our kitchens handle nuts, gluten, dairy and other allergens, so we can't guarantee any item is completely free from traces. If in doubt, ask one of the team.

3. Orders

When you place an order, you're making an offer to buy. BLUEYS can accept or decline any order at its discretion. Your order isn't confirmed until we accept it, and we need to receive and process your payment before that happens. Please check your order carefully before submitting it — once an order is accepted, we may not be able to change or cancel it. If we don't accept, change or cancel an order, we'll try to let you know using the email, address or phone number you gave us when ordering.

Catering and bookings. Catering orders, event bookings and space rentals are also governed by Section 4 (Catering orders, events and bookings), which sets out the lead times, minimums, deposits, changes and cancellation windows that apply to those orders.

Returns, exchanges and cancellations are handled in line with our Refund Policy [LINK] and your statutory rights as a consumer. Note that, under EU and Dutch law, perishable goods (such as freshly prepared food and drinks) and made-to-order catering are generally not eligible for the standard 14-day right of withdrawal.

4. Catering orders, events and bookings

This section applies to catering orders, event catering, grazing tables, platters, and any food or drink ordered for a specific date, location or group (together, "Catering Orders"), in addition to the rest of these Terms. Where this section conflicts with another part of these Terms for a Catering Order, this section applies to that order.

4.1 Quotes and confirmation. Our catering is made fresh to order. When you place a Catering Order or request a quote, you're making an offer to buy; no Catering Order is confirmed until we accept it in writing (by email or message). We aim to confirm within 24 hours. We may decline, limit or adjust any Catering Order at our discretion — for example due to capacity, lead time, location, or ingredient availability.

4.2 Lead time. Catering Orders must be placed at least 4 days before the requested catering date. We may, but aren't obliged to, accept shorter-notice orders — contact us and we'll do our best.

4.3 Minimum order and pricing. A minimum order value applies (currently €100, excluding delivery). Catering is generally priced per person based on the guest count you select, and confirmed when we accept your order. Where delivery applies, the charge is calculated by distance from your nearest kitchen and shown before you confirm.

4.4 Payment. Unless we agree otherwise in writing, you don't pay when you submit a Catering Order. Once we confirm it, we'll send a payment request, which must be paid by the date stated in that request. We may require a deposit or full payment before preparing larger or bespoke orders. If we've agreed invoice or business-account terms with you in advance, those terms apply.

4.5 Dietary requirements and allergens. You must provide all dietary requirements and allergens no later than 72 hours (3 days) before the catering date. Requests after this time may not be accommodated, due to supplier lead times. Our kitchens handle nuts, gluten, dairy and other allergens, and we can't guarantee any item is free from traces; for severe allergies, contact us before ordering. You're responsible for informing your own guests about ingredients and allergens.

4.6 Changes to your order. You may adjust your guest numbers by up to ±20% up to 24 hours before the catering date. After that point, or for larger changes, we may not be able to accommodate adjustments, as your order is already in production. Any agreed increase is subject to availability and may change the price.

4.7 Cancellations. Cancellation charges apply as set out in our Refund Policy [LINK]: free of charge up to 4 days before the catering date; 50% of the total order value if cancelled less than 4 days before; and 100% of the total order value if cancelled less than 48 hours before. The time we receive your cancellation is what counts.

4.8 Delivery, collection and access. Delivery and collection are governed by our Delivery & Pickup Policy [LINK]. For delivery, you're responsible for providing accurate address and access details and for ensuring someone is available to receive the order at the agreed time and place. If we can't complete delivery because no one is available or the details are wrong, the order may be treated as delivered and no refund will be due. Delivery and collection times are estimates and aren't guaranteed.

4.9 Food safety after handover. Our food is freshly prepared and intended to be served and eaten on the day of your event. Once your order has been delivered or collected, responsibility for storing, handling, refrigerating and serving it safely passes to you. We recommend keeping it refrigerated until shortly before serving and consuming it the same day. We're not responsible for issues arising from improper storage, handling or late consumption after handover.

4.10 Equipment and serviceware. Any platters, stands, crockery, linen or other equipment we provide on a loan or hire basis remains our property and must be returned clean and undamaged by the agreed date and method. You're responsible for loss of or damage to these items, and we may charge reasonable replacement costs.

4.11 Events and space rentals. Event bookings and space rentals (for example at Bluey's Oost) may carry additional terms, minimums, deposits, house rules and cancellation windows, which we'll set out at the time of booking and which form part of these Terms for that booking.

4.12 Force majeure. We're not liable for any failure or delay in fulfilling a Catering Order caused by events beyond our reasonable control (for example extreme weather, supplier failure, illness, strikes, or utility or transport disruption). If this happens, we'll contact you to reschedule or to refund amounts paid for the affected order, which — except as required by law — is your sole remedy in those circumstances.

5. Prices and payment

Prices, discounts and promotions can change without notice. The price you pay is the price shown when you place your order, and it'll be confirmed in your order confirmation email. Unless we say otherwise, prices shown include Dutch VAT (BTW) where applicable but exclude any delivery or service charges, which we'll show before you pay.

Prices in our online store may differ from prices in our cafés or anywhere else. From time to time we may run promotions with their own terms; if those conflict with these Terms, the promotion terms apply to that promotion.

You agree to give us current, complete and accurate payment and account details for every order, and to keep them up to date so we can process your order and reach you if needed.

You confirm that the payment details you provide are true and correct, that you're allowed to use the payment method, and that you'll pay the amounts due at the prices shown, including any delivery charges and applicable taxes.

6. Delivery and collection

Where we offer delivery or collection, all times are estimates only and aren't guaranteed. We're not responsible for delays caused by couriers or other things outside our reasonable control. To the extent permitted by law, once we hand an order to a carrier, the risk of loss or damage passes to you — though this doesn't affect your statutory rights as a consumer.

For catering, we usually deliver with our own team, and responsibility for the food passes to you on delivery or collection, as set out in Section 4.9 (Food safety after handover). Catering delivery and collection are also governed by our Delivery & Pickup Policy [LINK].

7. Intellectual property

Our Services — including all trade marks, brand names, text, images, graphics, reviews, video and audio, and the way they're selected and arranged — are owned by BLUEYS, its partners or its licensors and are protected by Dutch, EU and other intellectual property laws.

These Terms let you use the Services for your own personal, non-commercial use only. You mustn't copy, reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store or transmit any material from the Services without our prior written consent. Nothing in these Terms gives you any licence or rights to any BLUEYS, Shopify or third-party intellectual property, except as expressly stated. All rights not expressly granted are reserved.

The BLUEYS name, logo, illustrations, product and service names, designs and slogans are trade marks of BLUEYS or its licensors. Please don't use them without our prior written permission. Shopify's name, logo and marks belong to Shopify. All other names and marks on the Services belong to their respective owners.

8. Optional tools

You may get access to third-party tools through the Services that we don't monitor or control. We provide access to these "as is" and "as available", without any warranties or endorsement, and we're not liable for your use of them.

Using any optional third-party tool is entirely at your own risk, and you should make sure you're happy with the relevant provider's own terms. Any new features or tools we add later also form part of the Services and are covered by these Terms.

9. Third-party links

The Services may include content or links to websites run by others. We're not responsible for checking or assessing the content or accuracy of third-party materials or sites, and if you choose to visit them, you do so at your own risk.

To the extent permitted by law, we're not liable for any harm related to your use of third-party websites or anything you buy from them. Please read the relevant third party's policies before you deal with them, and direct any complaints about their products or services to them.

10. Relationship with Shopify

BLUEYS's online store is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with BLUEYS. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sale between you and BLUEYS, including any injury, damage or loss resulting from products or services you buy. You release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and dealings with BLUEYS.

11. Privacy

All personal data we collect through the Services is handled in line with our Privacy Policy [LINK], in accordance with the EU General Data Protection Regulation (GDPR). Some personal data may also be subject to Shopify's privacy policy. By using the Services, you confirm you've read these policies.

Because the Services are hosted by Shopify, Shopify collects and processes information about your use of the Services in order to provide and improve them. Information you submit may be shared with Shopify and other parties, who may be located outside the Netherlands, so we can deliver the Services to you. Please see our Privacy Policy for more on how we, Shopify and our partners use your personal data, and on your rights under the GDPR.

12. Feedback

If you send us ideas, suggestions, feedback, reviews, proposals or other content ("Feedback"), you grant us a perpetual, worldwide, sub-licensable, royalty-free licence to use, reproduce, modify, publish, distribute and display that Feedback in any medium and for any purpose, including commercially — for example, to operate, improve and promote the Services. Where applicable law gives you moral rights, you agree we may use your Feedback as described to the extent the law allows.

You also confirm that: (i) you own or have all necessary rights to your Feedback; (ii) you've disclosed any payment or incentive you received for it; and (iii) your Feedback complies with these Terms. We're not obliged to keep your Feedback confidential, pay for it, or respond to it.

We may (but don't have to) monitor, edit or remove Feedback we consider, at our discretion, to be unlawful, offensive, threatening, defamatory, obscene or otherwise objectionable, or that infringes anyone's rights or breaches these Terms.

You agree your Feedback won't infringe anyone's rights — including copyright, trade mark, privacy or personality rights — and won't be unlawful, abusive or obscene, or contain any virus or malware. Don't use a false email address or pretend to be someone else. You're solely responsible for any Feedback you provide and its accuracy, and we take no responsibility for Feedback posted by you or anyone else.

13. Errors, inaccuracies and omissions

Occasionally there may be information in the Services that contains typos, inaccuracies or omissions — for example, relating to product descriptions, prices, promotions, offers, charges, times or availability. We may correct these and change or update information, or cancel orders, if any information is inaccurate, at any time and without prior notice (including after you've placed your order).

14. Prohibited uses

You may use the Services for lawful purposes only. You may not use the Services, directly or indirectly:

  • for any unlawful or malicious purpose;
  • to break any applicable international, national, regional or local laws or regulations;
  • to infringe our intellectual property rights or those of others;
  • to harass, abuse, insult, harm, defame, intimidate or discriminate against our team or anyone else;
  • to transmit false or misleading information;
  • to send, receive, upload, download or re-use any material that doesn't comply with these Terms;
  • to send any unsolicited advertising or promotional material, such as junk mail, chain letters or spam;
  • to impersonate, or attempt to impersonate, any person or entity; or
  • to do anything else that restricts or inhibits anyone's use or enjoyment of the Services, or that could harm BLUEYS, Shopify or other users, or expose them to liability.

You also agree not to:

  • upload or transmit viruses or any other malicious code that could affect the Services;
  • reproduce, duplicate, copy, sell, resell or exploit any part of the Services;
  • collect or track other people's personal information;
  • spam, phish, pharm or pretext the Services;
  • use any robot, spider, scraper, data-gathering or extraction tool, or any automated means, to access the Services, except as expressly permitted under Section 15; or
  • interfere with, bypass or circumvent any security or access-control measures we use.

We may suspend, disable or terminate your account at any time, without notice, if we reasonably believe you've breached any part of these Terms.

15. Agents

15.1 This section ("Agent Terms") applies if you use, allow, enable or cause the deployment of an Agent to access, use or interact with any Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, a person or entity, and that can run on behalf of or using a person's device without direct supervision.

15.2 No Agent may access, use or interact with the Services unless it identifies itself and operates in strict accordance with Section 15.4 at all times. No Agent may access the Services if we've asked it to stop.

15.3 We may limit, including by technical means, whether and how any Agent accesses, uses and interacts with the Services.

15.4 Agents must: (i) in all HTTP/HTTPS requests, identify that the request is from an Agent and disclose the Agent's name in the user-agent string, in the form "Agent/[agent name]"; (ii) not conceal or obfuscate that the activity comes from an Agent, including by mimicking human behaviour or completing or bypassing CAPTCHAs or other measures designed to distinguish computers from humans; (iii) respond truthfully to any prompt seeking to determine whether the interaction is from a human or a computer; and (iv) not circumvent or avoid any measure intended to block, limit, modify or control how Agents access or use the Services.

16. Termination

We may terminate this agreement or your access to the Services (or any part of them) at our discretion at any time, and you'll remain liable for all amounts due up to and including the date of termination. This doesn't affect your statutory rights as a consumer.

The following sections survive termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law, Privacy, and any other provisions that by their nature should survive.

17. Disclaimer of warranties

The information in the Services is provided for general information only. To the extent permitted by law, we don't warrant that it's accurate, complete or useful, and any reliance you place on it is at your own risk.

Except as expressly stated by BLUEYS, and to the fullest extent permitted by law, the Services and all products offered through them are provided "as is" and "as available", without warranties or conditions of any kind, whether express or implied, including any implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, durability, title and non-infringement. We don't guarantee that your use of the Services will be uninterrupted, timely, secure or error-free. This section does not exclude or limit any warranty or right that can't be excluded or limited under Dutch or EU consumer law.

18. Limitation of liability

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can't be limited or excluded under applicable law — including your mandatory rights as a consumer.

Subject to the paragraph above, and to the fullest extent permitted by law, in no event will BLUEYS, our partners, officers, employees, affiliates, agents, contractors, service providers or licensors — or those of Shopify and its affiliates — be liable for any indirect, incidental, special or consequential loss or damage of any kind, including lost profits, lost revenue, lost savings, loss of data or replacement costs, arising from your use of the Services or any products bought through them, even if we've been advised of the possibility.

19. Indemnification

You agree to indemnify and hold harmless BLUEYS, Shopify and our affiliates, partners, officers, employees, agents, contractors, licensors and service providers from any losses, damages, liabilities or claims, including reasonable legal fees, payable to a third party arising out of (1) your breach of these Terms or the documents they refer to, (2) your breach of any law or of a third party's rights, or (3) your access to and use of the Services.

We'll notify you of any claim we seek to be indemnified for, though a delay in notifying you won't reduce your obligations unless it materially prejudices you. We may control the defence and settlement of such a claim at your expense, but we won't agree any settlement that imposes non-monetary obligations on you without your consent (not to be unreasonably withheld). You'll cooperate in defending indemnified claims.

20. Severability

If any provision of these Terms is found to be unlawful, void or unenforceable, it will still be enforced to the fullest extent permitted by law, and the unenforceable part will be treated as severed. This won't affect the validity of the remaining provisions.

21. Waiver and entire agreement

If we don't exercise or enforce any right or provision of these Terms, that isn't a waiver of that right or provision.

These Terms, together with any policies or operating rules we post, make up the entire agreement between you and us regarding your use of the Services, and replace any earlier agreements or proposals, whether spoken or written (including any earlier versions of these Terms).

Any ambiguity in these Terms won't be interpreted against the party that drafted them.

22. Assignment

You may not delegate, transfer or assign these Terms or any of your rights or obligations under them without our prior written consent, and any attempt to do so is void. We may transfer, assign or delegate these Terms and our rights and obligations without your consent or notice.

23. Governing law and jurisdiction

These Terms, and any separate agreement under which we provide you Services, are governed by and construed in accordance with the laws of the Netherlands. Any disputes will be submitted to the competent court in Amsterdam, the Netherlands, unless mandatory law (including consumer law) gives you the right to bring proceedings in another court. EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

24. Headings

Headings are included for convenience only and don't affect the interpretation of these Terms.

25. Changes to these Terms

You can review the most current version of these Terms at any time on this page. We may update, change or replace any part of these Terms at our discretion by posting changes on our website. We'll let you know about material changes in line with applicable law, and those changes take effect on the date stated in the notice. Continuing to use the Services after changes are posted means you accept them.
